NSW Fair Trading requires property licence and certificate holders to complete the continuing professional development set for their category and area of practice each CPD year. According to the official CPD page (last updated 9 July 2026), failure to comply with your CPD requirements may result in a penalty, or the suspension or cancellation of your licence or certificate. Fair Trading also states that non-compliance may result in a court penalty of up to $11,000.
The CPD year runs from 1 July to 30 June. For 2026–27, required CPD must be finished by 30 June 2027. A course intake in October is only a booking window. What Fair Trading says about CPD non-compliance
Stick to published wording. Fair Trading uses may, not will. Nothing on the official pages says a miss automatically triggers a fine, a show-cause notice, or a suspension clock.
Penalty, suspension or cancellation
On the CPD requirements page, Fair Trading says failure to comply may result in a penalty, or the suspension or cancellation of your licence or certificate, and may also result in a court penalty of up to $11,000. That is the official consequence language for CPD. Confirm it on the live page before you change office scripts.
Court maximum for CPD non-compliance ($11,000)
Fair Trading’s changes to property and stock agents laws page (published 8 July 2026) lists a new maximum court-imposed penalty of $11,000 for agents or assistant agents not complying with CPD requirements, among changes that started on 29 June 2026.
That figure is a maximum court-imposed penalty. It is not a typical fine, an infringement-notice amount, or a promise that every late file goes to court.
Further training or education directions
The same changes page says Fair Trading can direct an agent or assistant agent to undertake specified further training or education by a specified date if the Fair Trading Commissioner reasonably believes they have not complied with the property and stock agents laws or a condition of their licence or certificate. Frame that as a power that may be used, not as an automatic step after every late CPD file. Fair Trading has not published a CPD-specific notice script or response deadline on that page.
Related disciplinary context (general powers, not a CPD process)
Fair Trading’s disciplinary action page describes a general toolkit: caution or reprimand, undertakings, directives, monetary penalties, conditions, suspension, cancellation, and a notice to show cause. Grounds can include breach of the Act, the Regulation, or a licence or certificate condition.
That page is not a CPD-specific process map. Do not treat a particular show-cause path, timeline, or disciplinary dollar cap as the automatic result of missing CPD unless the CPD page says so.
The real deadline: CPD year vs booking intakes
CPD year = 1 July 2026 – 30 June 2027
Fair Trading: the CPD year for all licence and certificate holders starts on 1 July and ends on 30 June the following year. For 2026–27, the hard compliance end is 30 June 2027. Compulsory topics for the holder’s category and area of practice must be completed in that year with an approved provider, in an interactive format (face-to-face or interactive webinar), as Fair Trading publishes.
October intake is not the CPD deadline

Missing an October seat does not mean you have missed NSW CPD. Booking an early intake helps you finish well before 30 June 2027. The year still runs to that date.
LIC / agency view: staying ahead of non-compliance
Training plan and whole-office visibility
Fair Trading says Licensees-in-charge must have all CPD training detailed in the training plan for the agency. That is an office habit, not only a personal completion. Evidence and record-keeping
Fair Trading requires holders to keep records of compulsory topics and provide them if requested:
- Class 1 and Class 2 licence holders: keep records for 3 years
- Certificate of registration holders: keep records for 4 years (and statements of attainment for relevant Cert IV units as Fair Trading describes)
Keep a copy in the agency file as well as with each person. Do not invent extra retention years.
If the office is behind
Office habits only (not a Fair Trading-published process):
- Map who is incomplete by licence class and area of practice against Fair Trading’s live topics list
- Book approved interactive sessions early enough to finish before 30 June 2027
- Keep completion evidence in one agency file
- Do not assume a grace period beyond published exemptions
- If someone thinks an exemption applies, confirm the wording on Fair Trading before treating them as excused

Exemptions (high level only)
Fair Trading may, by written notice, exempt a licence or certificate holder from CPD requirements. There is also published language for licences or certificates that commenced less than 90 days before the end of the CPD year. For 2026–27, Fair Trading’s example is: if your licence or certificate commenced on or after 1 April 2027, you are automatically exempt from CPD for that year.
Fair Trading also notes a carve-out: that 90-day style exemption does not apply where a licence or certificate recommences after suspension or cancellation with a condition requiring specified CPD.
Do not invent how to apply, or who is eligible beyond that wording. Confirm on the Fair Trading CPD page.
How this differs from renewal and two-day intake posts
