What is personal information?
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether recorded in a material form or not.
Examples of personal information we may collect include your name, postal address, email address, phone number, NSW licence or certificate details, employer or agency information, billing details, training records, assessment results, and communications with our team.
We collect personal information so we can deliver CPD courses, manage enrolments, meet NSW Fair Trading reporting obligations, provide customer support, and improve our services.
Where it is reasonable and practicable, we collect personal information directly from you. When we collect information, we explain why it is needed and how we intend to use it, where appropriate.
Sensitive information
Sensitive information includes information about racial or ethnic origin, political opinions, religious beliefs, trade union membership, criminal record, health information, and other categories defined in the Privacy Act.
We generally do not ask you to provide sensitive information. If we do, we will only collect, use, or disclose it:
- for the primary purpose for which you gave it to us;
- for a secondary purpose that is directly related to the primary purpose;
- with your consent; or
- where required or authorised by law.
How we collect personal information
We may collect personal information when you create an account, purchase a course, enrol in training, complete assessments, contact us, subscribe to communications, attend webinars or face-to-face sessions, or use our website and learning platform.
Information may be collected through online forms, checkout, email, telephone, live chat, cookies and similar technologies, and from third parties where reasonably necessary — for example, payment processors, identity verification services, or your employer when arranging corporate enrolments.
We do not guarantee the privacy practices of third-party websites linked from our services. You should review the privacy policies of any external site you visit.
How we use personal information
We use personal information for purposes connected with providing NSW real estate CPD training and related services, including:
- verifying your identity and NSW licence or certificate eligibility;
- processing enrolments, payments, refunds, and account administration;
- delivering courses, assessments, certificates, and session scheduling;
- communicating with you about your account, training, and service updates;
- meeting our obligations as an approved CPD provider, including reporting to regulators where required;
- responding to enquiries, complaints, and suspected misconduct;
- improving our courses, platform, and customer experience through research and analysis;
- sending marketing communications where permitted, from which you may opt out at any time; and
- complying with legal obligations and assisting law enforcement or regulatory authorities where required.
If you choose not to provide information
If you do not provide information we reasonably require, we may be unable to enrol you in a course, issue a certificate, process a payment, or provide certain services.
When we disclose personal information
We may disclose personal information to:
- service providers who help us operate our business, such as payment processors, hosting providers, email platforms, analytics tools, and IT support contractors, subject to confidentiality and security obligations;
- NSW Fair Trading or other regulators where required under our conditions of approval as a CPD provider;
- your employer or agency where you are enrolled under a corporate arrangement and disclosure is necessary to administer that arrangement;
- professional advisers such as lawyers, accountants, or insurers where reasonably necessary; and
- other parties where you consent, or where disclosure is required or authorised by law.
Overseas disclosure
Some of our service providers may store or process information outside Australia. Where this occurs, we take reasonable steps to ensure overseas recipients handle personal information in a way that is consistent with the APPs, unless an exception applies.
Security and retention
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. Measures may include access controls, encryption, secure hosting, staff training, and contractual safeguards with service providers.
We retain personal information for as long as needed to provide services, meet legal and regulatory obligations, and resolve disputes. Training and enrolment records may be retained for at least seven (7) years, or longer where required by law or Fair Trading conditions.
When personal information is no longer required, we take reasonable steps to destroy or de-identify it, subject to applicable record-keeping requirements.
Access, correction, and complaints
You may request access to the personal information we hold about you and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant, or misleading, subject to exceptions under the Privacy Act.
To make a request, contact us in writing at info@edutive.com.au. We may need to verify your identity before releasing information. We do not charge a fee to make an access request, but we may charge a reasonable administrative fee for providing copies.
A copy of the APPs is available from the Office of the Australian Information Commissioner at aoic.gov.au.
