Terms of Service
These Terms of Service govern your use of EDUTIVE's website, learning platform, and Continuing Professional Development (CPD) training services. By creating an account, purchasing a course, or using our services, you agree to these Terms.

Agreement to these terms
These Terms form a legally binding agreement between you and Edutive Pty Ltd (ACN 643 701 919, ABN 86 643 701 919), trading as EDUTIVE.
If you do not agree to these Terms, you must not register for an account, purchase a course, or use our services. If we are delayed in exercising a right or do not enforce a right on one occasion, that does not waive our rights on any other occasion.
Accounts and eligibility
You must be at least 18 years old to create an account and use our services. If we discover an account was created in breach of these Terms, we may suspend or terminate it.
EDUTIVE may approve or reject account registrations at our discretion.
Consumer account
To purchase training at edutive.com.au, you must register a consumer account with your full legal name, billing address, phone number, a valid email address, and any other information we reasonably require.
Your name and NSW licence information are locked after registration. This reflects NSW Fair Trading requirements for approved CPD providers: student details may only be changed by the provider after verifying your identity. If your name or licence details are incorrect, contact info@edutive.com.au.
Student account
To access purchased course content on our online learning platform (online.edutive.com.au), a student account is required. We generally create this when your consumer account is set up. Login credentials are shared between both accounts, including password changes.
Initial student account details are sent to your primary email address on file.
Account security
You must provide accurate, complete, and up-to-date account information. You must not share your login credentials with anyone else. You are responsible for all activity on your account, including unauthorised use, and must notify us immediately if you suspect a security breach.
Communications
You agree that the email address associated with your account is our primary method of contacting you. You must monitor that inbox and ensure it can send and receive messages.
Account termination
You may request account termination by contacting us in writing. Termination does not automatically entitle you to a refund. See our Refunds section and Privacy Policy for information about how we handle account closure and personal information.
Course enrolment and licence
When you pay all required fees, EDUTIVE grants you a limited, non-exclusive, non-transferable licence to access and view purchased course content solely for your personal, non-commercial educational purposes, in accordance with these Terms and any course-specific conditions.
Except where we provide written permission, you must not reproduce, redistribute, sell, sublicense, broadcast, modify, or create derivative works from our course content.
Access is generally subject to a time limit — for example, three (3) or twelve (12) months from enrolment, depending on the product purchased. We may revoke access where required by law, policy, or Fair Trading conditions.
It is your responsibility to enrol in courses appropriate for your licence class and certificate category. If you are unsure of your licence class, check verify.licence.nsw.gov.au or contact us before purchasing.
CPD deadlines and compliance
NSW real estate licence and certificate holders must complete required Continuing Professional Development each CPD year. The CPD year runs from 1 July to 30 June the following year.
Failure to meet CPD requirements may result in suspension or cancellation of your licence or certificate, or other action by NSW Fair Trading.
EDUTIVE provides training resources and support, but you are responsible for completing your CPD before applicable deadlines. Completing a course with EDUTIVE does not by itself guarantee regulatory compliance if you have not met all NSW requirements for your licence category.
Pricing and payment
Prices are shown in Australian dollars (AUD). Prices may or may not include GST; applicable taxes may be added at checkout.
The price payable is the price displayed when you complete checkout. Promotional pricing may be time-limited. Some offers may be available only to eligible customers, such as new account holders.
You agree to pay all fees for courses you purchase and authorise us to charge your selected payment method. We use third-party payment processors to offer secure payment options. See our Privacy Policy for how payment information is handled.
You must not use an invalid or unauthorised payment method. If payment fails but access is granted, you agree to pay outstanding fees within thirty (30) days of our notice. We may disable access until payment is received.
Refunds
If the course you purchased is incorrect or not what you reasonably expected, you may request a refund within seven (7) days of purchase by contacting info@edutive.com.au.
Refunds are not available where you have completed the course, attended partial interactive training, or received a Certificate of Completion within the seven-day period.
We may issue refunds as account credit or to your original payment method at our discretion.
If you purchased the wrong course for your licence class, contact us promptly so we can help you switch to the correct course or arrange a refund where appropriate.
Promotional codes and credits
EDUTIVE or our partners may offer promotional codes, credits, or gift-style offers from time to time. These are subject to the terms displayed at the time of issue.
Unused promotional value may expire if not redeemed within the stated period. Unless required by law or expressly stated otherwise, promotional codes and credits are not redeemable for cash.
Content and acceptable use
You must use our services lawfully and in accordance with applicable local and national laws. You are responsible for understanding laws that apply to you.
You may interact with instructors, submit assessments, post reviews, or participate in training activities only in good faith. Do not submit content you do not have the right to share.
We may suspend or terminate your access, remove content, or close your account at any time if you breach these Terms or if we reasonably believe your conduct poses risk to EDUTIVE, other learners, or our regulatory obligations.
Your content
Content you submit — such as reviews, questions, assignment responses, or feedback — remains yours. By submitting content, you grant EDUTIVE a non-exclusive licence to use, reproduce, adapt, publish, and distribute that content for operating and improving our services, unless a narrower licence is required by law.
Our content and platform
EDUTIVE owns or licenses the platform, websites, branding, course materials, and proprietary systems. You must not copy, scrape, reverse engineer, or misuse our intellectual property except as permitted by these Terms or with our prior written consent.
Complaints and appeals
EDUTIVE is committed to fair, timely handling of complaints in line with our obligations as an approved CPD provider.
We encourage you to raise concerns promptly with our team so we can try to resolve them quickly. Complaints may be made verbally or in writing.
When we receive a written complaint, we acknowledge it in writing and refer it for investigation. We may request further information and review relevant records before deciding an outcome.
We aim to provide a written outcome within fourteen (14) business days of receiving a complaint, including reasons for our decision, your right of appeal, and how to lodge an appeal.
If you are dissatisfied with the outcome of a complaint appeal, you may contact NSW Fair Trading at fairtrading.nsw.gov.au.
Fraud prevention
EDUTIVE maintains fraud prevention policies and procedures to protect learners, payment systems, and the integrity of CPD training. We may verify identity, monitor unusual activity, and take action — including account suspension — where fraud or misuse is suspected.

Service availability and disclaimers
We aim to keep our website and learning platform available, but access may be interrupted for maintenance, upgrades, or events outside our reasonable control — including internet outages, natural disasters, or government restrictions.
We may change, suspend, or discontinue features or courses at any time. To the extent permitted by law, EDUTIVE and its affiliates, suppliers, partners, and agents are not liable for interruptions, feature changes, or unavailability of services.
Nothing in these Terms excludes, restricts, or modifies rights or remedies you may have under the Australian Consumer Law or other laws that cannot lawfully be excluded.
Privacy
Our collection and use of personal information is described in our Privacy Policy. By using our services, you acknowledge that we will handle personal information in accordance with that policy.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
